THIS IS A RELEASE OF LIABILITY & AGREEMENT TO INDEMNIFICATION.
PLEASE DO NOT ENTER OR ATTEND THE EVENT IF YOU DO NOT UNDERSTAND
OR DO NOT AGREE 100% TO THE TERMS. ALL GUESTS ATTENDING THE EVENT
ARE RESPONSIBLE FOR READING THIS WAIVER PROVIDED ON ALL E-TICKETS
AND POSTED AT EVENT ENTRANCE.
I hereby acknowledge that I voluntarily have applied to participate and attend,
Nightmare on Est event (hereinafter THE EVENT). I understand that the act of
being physically present inside THE EVENT involves risks of injury to me, other
people, which risks are entirely my responsibility. I expressly assume all these
risks. I agree to FOREVER RELEASE, INDEMNIFY AND HOLD HARMLESS THE
EVENT, THE EVENT ORGANIZERS and THE EVENT PARTNERS including but not
limited to Five Marketing Management LLC AND THEIR RESPECTIVE
MEMBERS, DIRECTORS, OFFICERS, AGENTS, VOLUNTEERS AND EMPLOYEES
from any and all claims, demands, damages, rights of action, or causes of action
present or future, whether the same be known or unknown, anticipated, resulting
from or arising out of my use or attendance to THE EVENT, whether such claims
are for loss, injury or death that may be alleged to have been caused directly or
indirectly to any person or thing by the act of other person, owners, guardians
while in or upon the grounds or near any entrance thereto. I agree that my
release, indemnification and holding harmless as provided herein also applies to
any and all loss and expense (including legal and expert witness fees) by reason
of the liability imposed by law upon any of the aforementioned parties. I
understand and expressly assume all additional risks. I further understand that
THE EVENT assumes NO liability for loss, damage, or any kind of injury sustained
by any persons while attending THE EVENT. I therefore expressly assume all
risks associated with attending THE EVENT, as well as, fixtures and equipment
located therein, in an unsupervised manner. I agree to carefully inspect and
satisfy myself that the facilities provided are safe for their intended use. Once
having conducted the inspection, I agree to expressly assume all risks for myself,
anyone accompanying me, at these premises.

By entering the event, I state that I:

1.) agree to the terms and conditions described herein and intend to be legally bound by them;

2.) I have read and fully understand THE EVENT rules; and

3.) Promise to comply fully with all the conditions of THE EVENT. 

This Release is intended to be as broad as permitted
by California law. If any provision of this Release is held invalid, the remaining
provisions shall not be affected.

I HAVE READ THIS RELEASE OF LIABILITY AGREEMENT, FULLY UNDERSTAND
AND AGREE TO ALL OF IT’S TERMS.  PLEASE DO NOT ATTEND THE NIGHTMARE
ON E STREET IF YOU DO NOT UNDERSTAND AND/OR DO NOT AGREE WITH THE

TERMS SET FORTH. ATTENDANCE OF THE EVENT IS AN UNCONDITIONAL
AGREEMENT TO ALL TERMS AND CONDITIONS.

I have read this release of liability agreement, fully understand it and agree to all
of it’s terms.
By attending Nightmare on E Street,

I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF
WHATEVER KIND OR NATURE AGAINST THE EVENT, THE EVENT ORGANIZERS
and THE EVENT PARTNERS AND THEIR CURRENT AND FORMER AFFILIATES,
PARTNERS, SPONSORS, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS,
VENDORS, SUCCESSORS, ASSIGNS AND AGENTS (THE “RELEASEES”), EITHER
IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW,
INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE
ACTS, OMISSIONS, NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE
PART OF THE RELEASEES AND OTHERS WHO ATTEND THE EVENT, AND/OR
THEIR FAMILIES, COLLEAGUES OR OTHERS WITH WHOM THEY MAY HAVE OR
HAVE HAD CONTACT, INCLUDING BUT NOT LIMITED TO DEATH,
BODILY/PERSONAL INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET
EXPENSES, LOSS OR DAMAGE TO PROPERTY, OR OTHER LOSS SUFFERED AS
A RESULT OF MY ATTENDANCE AT THE EVENT, WHICH I, MY HEIRS,
ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED
REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY
BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY ATTENDANCE AT
THE EVENT. YOU ALSO AGREE THAT AS THE BUYER OF THE TICKETS, YOU
ARE RESPONSIBLE FOR NOTIFYING ALL GUESTS IN YOUR PARTY OF THIS
RELEASE AND ALL TERMS AND CONDITIONS.

Nightmare on Est Terms and Conditions:

I understand I must be 21 or over to attend Nightmare on Est. I understand
that I will be asked to leave and not allowed into the event if too intoxicated. I
understand that there is a zero tolerance for drugs and that I will be immediately
detained or removed from the event and maybe reported to the authorities. I
understand that I must be considerate of other guests and that there is a zero
tolerance for fights or physical altercations and that I will be detained and/or
removed from the event for any altercations.

Refund and Cancellation Policy:

Please note that tickets to this event are non-refundable and that there are no
refunds. If your event is cancelled and not rescheduled, we will refund the
amount you paid for your tickets (minus order processing, service and delivery
fees) using the same payment method used for purchase. All Event personnel
have the right to refuse entry to any ticket holder for any reason at their
discretion. Venue and Talent are subject to change without notice and are not grounds for a refund.

Anything promised by the promoter that is unfulfilled is not
guaranteed by the seller and is not grounds for a refund.
Photo/video release statement:

I am aware that by entering this event, I consent to any photos or videography of
me to be used without compensation, in films and tapes for use in any and all
media whether now known or hereafter devised, for eternity and you release Five
Marketing and Management LLC and its successors, assigns and licensees from
any liability whatsoever of any nature. I am agreeing that by attending
Nightmare on E Street, I release liability to photos and videos of myself and my
guests for publication on social, website and additional uses, organizers deem
necessary unless the user expressly files with Nightmare on E Street  a written
objection as to photos or videos of themselves. I agree that as the buyer of the
tickets, I am responsible for notifying all guests in my party of this release and
the use of event tickets by user is agreement to our terms.
